Licence Suspension Appeals for Speeding Offences

Speeding is a serious offence in NSW. If you are caught speeding, you will be ordered to pay a fine. You will also earn some demerit points. And if you exceed the speed limit by over 45 km/hour, your licence will be confiscated and suspended there and then for at least 6 months.

Over speeding is a valid reason to have your licence suspended. And as you may know, you will face a lot of difficulties without the license. If you are facing this situation, it is possible to appeal the decision of the RMS.

When a motorist appeals against the suspension of their licence, the court may take any one of the following actions.

The court may uphold your appeal

If your appeal is successful, your licence will not be suspended and you can continue driving.

The court may shorten the length of suspension

The suspension still applies but the suspension period is reduced.

The court may dismiss your appeal

If your appeal is not successful, you cannot drive for the period of your suspension.

Penalties for speeding

Penalties for full licence holders for exceeding speed limits in non-school zones

If you exceed the speed limit by over 30 km per hour, you earn five demerit points and an $872 fine. In addition, the RMS will suspend your licence for a minimum of 3 months.

Penalties are more severe if you exceed the speed limit by more than 45 km per hour. You will get 6 demerit points and a fine of $2,350. In addition, your licence will be suspended for a minimum of 6 months. If you are caught speeding by over 45 km per hour, the police officer will most probably suspend and confiscate your licence at the roadside.

If you are a full licence holder, you won’t face suspension for exceeding the speed limit by up to 30 km/hour. However, you will still earn demerit points. You will also be ordered to pay a fine.

Penalties for speeding in school zones are even more severe. If you do not exceed the speed limit by more than 30 km per hour, you will get 5 demerit points and a $568 fine. You will be fined $1,099 for exceeding the speed limit by over 30 km per hour and $2,504 for exceeding the speed limit by over 45 km per hour. You also earn demerit points and minimum 3 months of suspension.

Learners and P1 or P2 licence holders can face more serious penalties. If they exceed the speed limit by even a little, their licence will be suspended for at least 3 months.

If you get convicted by a court, the maximum fine for exceeding the speed limit by over 45 km per hour is $2,530. In addition, your licence will be suspended for at least 6 months. Maximum monetary fine for light vehicles for exceeding the speed limit by not more than 10 km per hour is $2,200. On long weekends or declared public holidays, the demerit points for speeding are doubled.
