Navigating Demerit Points: How They Affect Your License

When you commit certain traffic offences in NSW, you receive demerit points in addition to fines or penalties. These points are recorded against your driver’s licence and remain active for three years from the date of the offence.

Common Offences and Associated Points

Offence Demerit Points
Speeding (under 10km/h over) 1
Speeding (over 10km/h) 3 – 6
Using a mobile phone while driving 5
Failing to stop at red lights or stop signs 3
Not wearing a seatbelt 3
Drink driving Up to 6 (plus additional legal penalties)

Note: During double demerit periods (e.g., long weekends, public holidays), points can double.

How Many Points Before You Lose Your Licence?

The number of demerit points you’re allowed to accumulate depends on your licence type:

  • Unrestricted licence: 13 points

  • Professional drivers (e.g. taxi, bus): 14 points

  • Provisional P2 licence: 7 points

  • Provisional P1 licence: 4 points

  • Learner licence: 4 points

If you exceed your point limit, your licence may be suspended, usually for 3 months or longer depending on how many points you’ve accrued.

What Happens If You Exceed the Limit?

If you go over your demerit point limit, Transport for NSW will issue a Notice of Suspension. You can:

  1. Serve the suspension period, or

  2. Apply for a good behaviour period (available only for unrestricted licence holders).

Good Behaviour Option

  • Lasts 12 months

  • You must not accumulate more than 2 points during this time

  • If you breach it, you face double the original suspension period

Strategies to Manage and Minimise Demerit Points

  1. Drive Cautiously
The best way to avoid demerit points is to stick to road rules—especially around speed limits, school zones, and mobile phone use.

  2. Stay Informed
You can check your demerit point balance through the Service NSW website.

  3. Appeal or Dispute Fines
If you believe a fine was wrongly issued, you may request a review or challenge it in court. Successfully dismissed charges won’t add points to your record.

  4. Legal Advice
If you’re facing a suspension or court case, speak with a traffic lawyer. At LY Lawyers, we regularly help clients reduce fines, avoid suspensions, and appeal decisions.

  5. Avoid Double Demerits
Be extra cautious during double demerit periods—simple mistakes can have double the consequences.

Demerit points are more than just numbers—they directly impact your ability to drive and your legal standing. Knowing your limits, staying updated, and seeking legal help early can make all the difference.
